The Middletown Planning Board Decision
On June 20,, 2012, the Middletown Planning Board voted 9-0 to reject the application of Four Ponds Associates to build a 342-unit Townhouse/Apartment Complex near the center of the Village of Lincroft. The Board’s Resolution of Denial relied heavily on the testimony of the expert witnesses who were hired by SONIC (Save Our Neighborhood’s Integrity and Character) and presented by SONIC’s counsel, Mr. Ron Gasiorowski.
The Four Ponds Appeal
Four Ponds has appealed this denial to the Superior Court of NJ through a “Complaint in Lieu of Prerogative Writs” suit. The issues in question are:
a) Was the Planning Board denial arbitrary, unreasonable or capricious?
b) Were Four Ponds’ proofs so overwhelming that the Planning Board was required as a matter of law to approve the application?
SONIC Representation During the Appeal Process
To make it possible for the opinions of local citizens to be heard during this appeal process, Mr. Gasiorowski has been retained to continue his work on behalf of SONIC. Mr. Gasiorowski has filed a Motion to Intervene on behalf of SONIC, and overcame the objections of Four Ponds. Representation is critical for community involvement should a proposed settlement be discussed. An attempt could be made by Four Ponds to settle this matter through negotiations, but concurrence on the part of the Intervener (SONIC) would be a key requirement. A July 2013 trial date is expected.
Fees Incurred and Future Fundraising
During the original Planning Board hearings, which took just over a year to complete, we incurred $60,000 in professional fees. These fees covered the cost of counsel and our three expert witnesses, who carefully built the record that supports the decision of the Board. Our legal action requires both time and money: we ask that you show your strong support for our common cause by donating to the Four Ponds Opposition Fund. Funds are being collected, escrowed, and disbursed by the LVGA who is assisting SONIC in the opposition to this application. Thank you for your concern for our community’s integrity and character!

County Multi-purpose Path Construction along CR520:  The paved pedestrian path within Thompson Park that allows travel along Route 520 between Cross Farm Park in Holmdel and the Thompson Park entrance in Lincroft was completed with the addition of two bridges. The County of Monmouth constructed a pedestrian bridge across the pond near the Christian Brothers Academy entrance while the Monmouth County Parks System constructed a pedestrian bridge across the pond adjacent to Cross Farm Park. We advocated for these plans to be implemented since 2004, advancing the proposals through the county and state government with letters, phone calls, public comment and personal meetings. more>

Middletown Township approves development at Bamm Hollow property.  The approval allows for the building of 190 single-family homes on 1+ acre lots with 120 acres of open space on part of the current Bamm Hollow property.  No affordable housing units (COAH) are planned.  Read an Independent article here, a Red Bank Green article here and an Asbury Press Article here. CR 520 Study. Monmouth County has announced that the County will be commissioning an engineering firm to study CR520 in 2011.  Middletown has assured the county that the needed improvements to the Acme access road will be completed.  Read more>

Middletown Affordable Housing proposal: Please see the summary of the November 2010 Annual Membership Meeting where Middletown Township Administrator, Tony Mercantante, and Middletown Township Planner, Jason Greenspan, spoke on this topic. Summary is here. History:  On July 20, 2009 the Township Committee passed an Ordinance #2009-2979 (Section 3, read here) that changes the Master Plan to rezone the Avaya property for multi-family dwellings, paving the way for a large development of townhouses (most likely) with 20% of them being Affordable Housing. (Read Asbury Press article here.) The Planning Board had held a Special Meeting on Wednesday, July 15th, at which they adopted a July 2009 Reexamination Report and Amended Master Plan Land Use Element. The Amended Master Plan is on the Township's website and can be viewed at here. The Planning Board also passed a Resolution, recommending the adoption of Ordinance #2009-2979. In April of 2010 the state approved Middletown's Affordable Housing proposal which was passed by the Township Committe on Dec. 11, 2008. That proposal can be read here and included 375 units to be built at the 68 acre Avaya location on Middletown-Lincroft Rd with 75 designated as 'affordable' rentals. We encourage you to write to our various public officials to voice your displeasure regarding the COAH mandate. Feel free to add additional comments of your own.
